Optimal Her App — Terms of Use

1. What the App is, and what it is not

The App is an education and self-tracking companion for women using GLP-1 or hormone therapy. It includes a plan built from your answers, daily check-ins, logs, reminders, an AI assistant, and booking with the clinic.

The App does not provide medical care. It does not diagnose, treat or prescribe, and it does not tell you what dose to take or when to change it. Your prescriber makes those decisions. Using the App does not create a patient relationship with the clinic; that is created only through the clinic’s own intake and visits. If anything in the App differs from your provider’s advice, follow your provider.

2. In an emergency

The App is not an emergency service and is not monitored in real time. If you think you are having a medical emergency, call 911. If you are in crisis or thinking about harming yourself, call or text 988 (Suicide & Crisis Lifeline). Do not wait for a reply in the App.

3. The AI assistant and photo scans

The assistant and the meal and label scans use a third-party AI service, only after you give permission in the App. AI replies and scan results can be wrong or incomplete, including nutrition figures. Do not rely on them for medical decisions, and check anything important with your provider. The assistant is not a member of the clinic team.

4. Who can use the App

You must be 18 or older and able to enter into this agreement. You agree that the information you give us is accurate to the best of your knowledge and that you will keep it up to date.

5. Your account

You sign in with your email (using a one-time code), Apple or Google. Keep access to that email or account secure, because anyone with it can sign in as you. Tell us right away if you think someone else has accessed your account. You can delete your account at any time in Settings → Delete my account.

6. Membership and subscription

Clinic patients. If the clinic gives you a patient code, entering it links your account to your patient record and gives you access to the App at no charge for as long as the clinic keeps that link active.

Subscription. Other members can subscribe through the Apple App Store:

• Optimal Her Membership: $79.00 (USD) per month, or the price shown in the App for your region.
• Free trial: new subscribers who are eligible get a 7-day free trial. If you don’t cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
• Automatic renewal: the subscription renews each month unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged within 24 hours before each renewal.
• Cancelling: manage or cancel in your device’s Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you’ve paid for.
• Payments and refunds are handled by Apple under Apple’s terms. We never see your card details and cannot issue App Store refunds; request them from Apple at reportaproblem.apple.com.
• Deleting your account does not cancel your subscription. Cancel it with Apple first.

We may change the price or the features included. Apple will tell you before a price increase takes effect, and you can cancel before it does.

7. Acceptable use

You agree not to:

• use the App for anyone other than yourself, or share your account;
• enter information you know to be false, or someone else’s health information without their permission;
• try to access other members’ data, or our systems, beyond what the App allows;
• copy, reverse engineer, or interfere with the App or its security, except where the law allows it;
• use the App, including the assistant, to create unlawful, harmful or abusive content.

We may suspend or close an account that breaks these terms, or to protect members’ safety or our systems.

8. Your content

What you log and write in the App stays yours. You give us permission to store and process it to run the App for you, as described in the Privacy Policy. For clinic patients, this includes sharing it with your care team where you choose to.

9. Our content

The App, its design, plans, articles, videos and other content belong to us or our licensors. We give you a personal, non-transferable, revocable license to use the App on Apple devices you own or control, for your own non-commercial use, under these terms and Apple’s Usage Rules. Third-party content in the App, such as videos or food database results, is provided by those third parties under their own terms.

10. Changes to the App and these terms

We may add, change or remove features. If we change these terms in a way that matters, we will tell you in the App, and continued use after the change means you accept it. The “Last updated” date shows the latest version.

11. Disclaimers

To the extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not promise that the App will be uninterrupted or error free, or that it will produce any particular health, weight or wellness result.

12. Limitation of liability

To the extent the law allows, we and our staff are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the App or from relying on information in it. Our total liability for any claim about the App is limited to the amount you paid us for the App in the 12 months before the claim, or $100 if you paid nothing. Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

You agree to cover our reasonable costs from claims caused by your breach of these terms or your misuse of the App.

14. Apple

These terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation for the App. We, not Apple, are responsible for any claims about the App, including product liability, failure to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the App infringes someone’s intellectual property. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Warren County, Ohio, unless the law where you live gives you the right to bring it elsewhere.

16. General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them as part of a merger or sale of the business.
